What Is a Spendthrift Trust?

Quick answer: A spendthrift trust contains a legal clause preventing the beneficiary from pledging, assigning, or borrowing against their trust distributions before they're made. This shields the trust principal from the beneficiary's creditors โ€” including divorcing spouses, lawsuit plaintiffs, and their own bad financial decisions. The trustee controls distributions, and creditors can only reach funds after a distribution is actually paid to the beneficiary.

How the Spendthrift Clause Works

Most trusts include a standard spendthrift clause almost as boilerplate โ€” it's a one- or two-sentence addition that creates significant protection. The clause states that the beneficiary cannot voluntarily transfer or pledge their interest in the trust, and that creditors cannot reach trust assets before distribution. Under Texas Trust Code ยง 112.035, Texas fully recognizes and enforces spendthrift provisions, making them highly effective.

A creditor who wants to reach trust assets must wait until a distribution is made โ€” then can only attach that distributed amount. They cannot force the trustee to make a distribution, and if the trustee has discretion over distributions, the creditor may get nothing if the trustee exercises that discretion appropriately.

Who Benefits Most from Spendthrift Provisions

Exceptions: When Spendthrift Protection Doesn't Apply

Texas law carves out certain creditors who can reach spendthrift trust assets despite the clause: child support and alimony claimants, government claims (taxes, Medicaid), and creditors who provided necessary services directly to the beneficiary (food, shelter, medical care) in some circumstances. A spendthrift trust also cannot protect the grantor from their own creditors if the grantor is also a beneficiary โ€” this is why self-settled domestic asset protection trusts in most states don't work the same way. Work with a trust attorney to draft spendthrift provisions correctly and understand the applicable exceptions.
